Terms of Use – Papyr

1. Acceptance

These Terms of Use govern your use of the Papyr iOS app and the website https://usepapyr.app, provided by Marcel Rückert, Schillerring 20, 65795 Hattersheim am Main, Germany (“we,” “us”). By downloading, installing, or using Papyr, you agree to these Terms. If you do not agree, do not use Papyr.

2. The service

Papyr is a native iOS app for scanning, recognizing (OCR), categorizing, and archiving documents. Document contents are processed and stored on your device, and optionally synced to your own iCloud (Apple). We have no access to your document contents. Our handling of data is described in our Privacy Policy. We may change, add, or discontinue features and do not warrant uninterrupted availability.

3. App Store and Apple’s license terms

You obtain the app through the Apple App Store, and Apple’s terms also apply. Apple’s standard Licensed Application End User License Agreement applies to your license to use the app, except where these Terms provide otherwise; Apple’s mandatory terms control in case of conflict.

4. License

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use Papyr on Apple-branded devices associated with your Apple ID, subject to these Terms. The app is licensed, not sold.

5. Acceptable use

You agree not to: use Papyr for any unlawful purpose or to process documents you have no right to use; reverse engineer, decompile, modify, or circumvent security or licensing measures except as permitted by law; or interfere with the integrity or availability of the service.

6. Your data and backups

Because Papyr stores your content only on your device or in your own iCloud, you are solely responsible for backing up your data. We have no access to your content and cannot recover lost or deleted data. iCloud sync is additionally subject to Apple’s terms. We recommend maintaining your own backups.

7. Subscriptions and billing

Papyr is free to download. Certain premium features may be unlocked through an in-app subscription. Purchases and subscriptions are processed through your Apple App Store account; billing, renewal, and cancellation are handled by Apple under Apple’s terms. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period in your App Store settings. Prices and terms: starting from $1.99/month / free trial if offered.

8. Intellectual property

All rights in the app, its software, design, and the “Papyr” name and logo belong to us. No rights are granted beyond the license in Section 4.

9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAPYR IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that OCR results are accurate or that the app will be error-free or uninterrupted.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, ARISING FROM OR RELATED TO YOUR USE OF PAPYR. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM OR USD 50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you; nothing limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your misuse of Papyr or your violation of these Terms or of applicable law.

12. Termination

These Terms remain in effect while you use Papyr. You may stop using it at any time by uninstalling; cancel any subscription via the App Store. We may suspend or terminate your access for material breach of Section 5.

13. Changes

We may update these Terms prospectively for good cause (e.g., legal changes, new features) without unreasonably disadvantaging you, and will notify you of material changes by appropriate means.

14. Governing law and disputes

These Terms are governed by the laws of Germany, without regard to conflict-of-laws rules and excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rights of your state or country of residence remain unaffected. The parties will first attempt to resolve disputes informally by contacting hello@usepapyr.app before pursuing formal proceedings.

15. Apple-specific terms

Apple is not a party to these Terms and is not responsible for the app. We, not Apple, are solely responsible (to the extent permitted by law) for the app, support, warranty, and any third-party claims relating to product liability or intellectual-property infringement. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
